Final Code of Compliance
A Code Compliance Certificate (if and when issued) ends the (building consent)process, and is a Certificate issued by the Building Consent Authority if it is satisfied on reasonable grounds that the building work complies with the building consent. To enable us to issue the Code Compliance Certificate you will need to apply to the Council on the prescribed form as soon as practicable after all the work under the building consent has been completed. The form for this is attached to the building consent, and when completed should be returned to the Building Consent Authority along with any energy certificates and project specific producer statements as applicable. The Building Act 2004 requires the Building Consent Authority to decide whether to issue the Code Compliance Certificate (if not suspended for further information) within 20 working days after receipt of the application or, if there has been no application, 2 years after the building consent was granted. It is Building Consent Authority practice to send 2 reminder letters out at 3 months and 1 month prior to the end of the 2 year period, and it should be noted that you may apply to the Building Consent Authority for an extension of time to complete the work. A final inspection of the work will also be carried out to ensure it complies with the building consent. Any additional cost incurred by the Building Consent Authority over and above that paid at the time of issue of the building consent or any outstanding development contributions are payable prior to the issue of the Code Compliance Certificate.
Commercial/Industrial and occasional residential - If the building contains specified systems then a Compliance Schedule including inspection, maintenance and reporting procedures for the specified systems as defined by the applicant and a Compliance Schedule Statement will be issued with the Code Compliance Certificate.
